According to this CBC News article (http://www.cbc.ca/consumer/story/2009/10/01/ontario-e-bike-rules.html) the MTO has decided to continue treating E-Bikes the same as during their 3 year pilot (which expires Oct 3, 2009) with three amendments: 1) Cannot have a maximum weight above 120 kilograms. 2) Must have a maximum braking distance of nine metres. 3) Cannot undergo any modifications to their electric motors to generate speeds greater than 32 km/h, the maximum allowed for e-bike motors.
So while I'm pleased they didn't ban e-bikes outright, they essentially killed e-scooters. 120 kg minus the weight of an adult doesn't leave much for the bike. This pushes e-scooters into the category of "Limited Speed Motorcycle" which requires license, plates and insurance. Edit: Thanks to danmick who pointed out the weight does not include the rider!
The Gio e-bike (what I have) weighs 165 lbs. 120kg = 265 lbs. 265 lbs - 165 lbs = 100 lbs. 100 lbs! So very tiny people could legally drive my e-bike, but if they happen to eat a box of donuts one day, the status of their vehicle changes?
I looked into upgrading to the proper helmet. There seems to be a few stores for helmets:
