Well it appears ISPs have already begun to favour some services over others, at different points of the day.  Here is evidence (and admission) from Verizon that they are in fact throttling Netflix starting at 4pm every day.

From a support agent on Verizon Live Chat:

Agent: Yes, it is limited bandwidth to cloud providers
Customer: I suppose this started recently [a]nd this is why my netflix quality is also bad now
Agent: Yes, exactly.
